ORDINANCE NO. 487.4

 

AN ORDINANCE OF THE COUNTY OF RIVERSIDE PROVIDING FOR AN AVIATION COMMISSION, AN AVIATION DEPARTMENT, AND THE

OPERATION OF COUNTY AIRPORTS

 

 

        The Board of Supervisors of the County of Riverside, State of California, do ordain as follows.

 

ORDINANCE NOS 487.1,487.2 AND 487.3 ARE HEREBY REPEALED IN ITS ENTIRETY.

 

Section1.        There is established the Riverside County Aviation Commission consisting of five members. The Board of Supervisors shall appoint the members of said Commission for two year terms, which shall commence on the first day of July in odd-numbered years as to 3 members, and in even numbered years as to 2 members. Vacancies shall be filled for the unexpired terms. (REPEALED BY 487.4)

 

Section 2.  Said Commission shall be and advisory body to the Board duty of said Commission to advise and make recommendations to the Board of Supervisors on all matters of policy concerning the acquisition, development, operation and maintenance of airports and airport properties of the County, and concerning the functions of the aviation department of the County. (REPEALED BY 487.4)

 

        The Commission shall establish rules for its own procedure which shall, among other things, provide for regular meetings at least monthly and fix or provide for fixing the time and place thereof. (REPEALED BY 487.4)

       

        The Commission, after adequate study and discussion, shall forward to the Board of Supervisors through the Aviation Director its recommendations on all matters requiring approval by the Board of Supervisors. (REPEALED BY 487.4)   

 

Section 3. There is established without the County government an Aviation department, which shall be headed by a component person designated as Aviation Director, who shall be appointed by and hold his position at the pleasure of the Board of Supervisors. (REPEALED BY 487.4)

 

Section 4.  It shall be the duty of said Aviation Director, subject to policy direction of the Board of Supervisors and within the limits of applicable laws, ordinances and regulations, to: (REPEALED BY 487.4)

 

a.Attend meetings of the Commission, serve as Secretary of the Commission, without vote, and render such technical and clerical assistance as is requested; (REPEALED BY 487.4)

b.Present the advice and recommendations of the Commission to the Board of Supervisors, and keep the Commission advised of the Board’s actions and requests; (REPEALED BY 487.4)

c. Administer his department and the county airports on as nearly a self sustaining basis as possible, and perform all administrative acts in connection with the acquisition, development, operation and maintenance of the county airports and airport properties as directed by the Board of Supervisors; (REPEALED BY 487.4)

d.  Negotiate leases, and other agreements relating to the acquisition, development, operation and maintenance of county airports, subject to (1) the provisions contained in subsection h of Section 4 herein and (2) the final approval of the Board of Supervisors, except as they may expressly delegate to him authority for final action. (REPEALED BY 487.4)

e. Oversee the activities conducted at the County airports and comply, and secure compliance by others using the county airports, with all applicable governmental orders, rules and regulations relating to air navigation and airport operations. (REPEALED BY 487.4)

f. Deal with governmental agencies; (REPEALED BY 487.4)

g. Represent the County for the purpose of dealing with other public entities relating to aviation matters. (REPEALED BY 487.4)

h. Advise the Commission as to departmental activities and progress, and obtain recommendations from the Commission relating to all matters requiring approval by the Board of Supervisors, except as to those matters which require action to be taken by the Board on an urgency basis that preclude timely recommendations by the Commission. (REPEALED BY 487.4)

 

Section 5.

 

        There is established in the county treasury an “Aviation Fund” into which shall be paid all revenue derived from county airport activities and such other funds as the Board of Supervisors may determine, and from which shall be paid the operating and other appropriate expenses and costs hereunder. (REPEALED BY 487.4)

 

Section 6.

 

        Each member of the Commission shall be qualified as an expert in one or more phases of aviation or airport activities, by virtue of substantial participation therein for at least one year, but in lieu of such qualification not more than two members, shall be similarly qualified by substantial experience and responsibility in the fields of construction engineering or commercial or industrial management. (REPEALED BY 487.4)

 

Section 7.

 

        Each member of the Commission shall serve without compensation but shall be allowed at county rates his actual and necessary travel expenses incurred in the discharge of official duties within the County, and, with prior approval of the Board of Supervisors, outside of the County. (REPEALED BY 487.4)

 

Section 8.

 

        Ordinances Nos. 334 and 334.1 are repealed, but except where inconsistent therewith, this ordinance shall be deemed a continuation of the provisions thereof. (REPEALED BY 487.4)

 

Section 9.

 

        This ordinance shall take effect 30 days after its adoption.
