ORDINANCE NO. 619

AN ORDINANCE OF THE COUNTY OF RIVERSIDE

DECLARING THE NEED FOR THE SURPLUS PROPERTY

AUTHORITY OF THE COUNTY OF RIVERSIDE.

                                                            

 

The Board of Supervisors of the County of Riverside, State of California, do ordain as follows:

Section 1.  The County of Riverside (the "County") desires to purchase surplus real properties of the United States which are within or contiguous to the County.

 

Section 2.  Sections 40501 and 40502 of the Government Code of the State of California ("Government Code") determine that in order for the County to acquire, own, maintain, operate, improve and dispose of such property that a public corporation, separate and distinct from the County, is necessary.

 

Section 3.  According to Section 40520 of the Government Code there is in the County a public corporation known as the Surplus Property Authority of the County of Riverside (the "Authority").

 

Section 4.  Pursuant to Section 40521 of the Government Code, the Authority shall not transact any business until the Board of Supervisors of the County declares by ordinance that there is a need for the Authority to function in the County.

 

Section 5.  For the above specified reasons and pursuant to Chapter 19 of Part 2 of Division 3 of Title 4 of the Government Code, Section 40500, et seq., it is hereby determined and declared that there is need for the Authority to function in the County of Riverside.

 

Section 6.  The governing body of the Authority shall be known as the Surplus Property Commission (the "Commission").  The members of the Commission (the "Commissioners") shall be the members of the Board of Supervisors of the County of Riverside, who shall act ex officio.

 

Section 7.  Within thirty (30) days after the date this ordinance becomes effective, as provided for herein, the Commissioners shall meet and organize as a Board of Commissioners, and shall:

a.  Designate the Chairman of the Board of Supervisors or one of

its members as president of the Commission pursuant to Government Code Section 40532.

b.  Designate the Clerk of the Board of Supervisors, or other

competent person, as Clerk of the Commission pursuant to Government Code Section 40533.

c.  Appoint such other officers as it deems advisable.

d.  Provide for the time and place of holding its regular and

special meetings.


Section 8.  The Commission may transact any business of the Authority at the above‑mentioned organizational meeting or thereafter.

 

Section 9.  The Commission shall act in the manner and subject to the laws provided for the Board of Supervisors of the County, as well as the provisions of Chapter 19 of Part 2 of Division 3 of Title 4 of the Government Code, commencing with Section 40500.

 

Section 10.  The Authority shall be managed under the provisions of Chapter 19 of Part 2 of Division 3 of Title 4 of the Government Code, commencing with Section 40500.  Moreover, the Authority may exercise the powers therein expressly granted or necessarily implied therefrom, and may perform all acts necessary to carry out fully the provisions of said chapter.
