ORDINANCE NO. 727

 

AN ORDINANCE OF THE COUNTY OF RIVERSIDE

AUTHORIZING THE PALM DESERT REDEVELOPMENT AGENCY

TO DEVELOP A REDEVELOPMENT PLAN FOR A PORTION OF

THE UNINCORPORATED AREA CONTIGUOUS TO THE CITY OF

PALM DESERT PURSUANT TO SECTION 33213 OF THE

CALIFORNIA HEALTH AND SAFETY CODE

 

 

The Board of Supervisors of the County of Riverside, State of California, do ordain as follows:

 

Section 1. The City of Palm Desert has requested that the Board of Supervisors, pursuant to Section 33213 of the California Health and Safety Code, designate and authorize the Palm Desert Redevelopment Agency to undertake the redevelopment of that certain real property located within the territorial limits of the County of Riverside, contiguous to the City of Palm Desert, more particularly described on Exhibit A, attached hereto. The Board of Supervisors finds that said Section 33213 permits the Board to "authorize the redevelopment of an area within its territorial limits by another community if such area is contiguous to such other community," and determines that the subject properties hereinabove referred to are contiguous to the City of Palm Desert.

 

Section 2. The Board of Supervisors further finds, pursuant to said Section 33213 that any final redevelopment plan for the project area must be approved by the Board prior to its final adoption by the Redevelopment Agency, and the Board requests the submission of additional factual and financial information and data by the Redevelopment Agency prior to the submission of the redevelopment plan to this Board for final approval.

 

Section 3. The City of Palm Desert and the Palm Desert Redevelopment Agency are hereby authorized to develop a redevelopment plan for the described area in all respects as if the area were within the territorial limits of the City of Palm Desert, except as provided for herein.

 

Section 4. The City Council and Planning Commission of the City of Palm Desert Redevelopment Agency shall have only those rights, powers and privileges with respect to such area that are necessary for the completion of the proposed redevelopment project.

 

Section 5. The redevelopment project area may include all or any portion of the area described in the attached Exhibit A, and the redevelopment plan for such area shall be approved in accordance with all approvals and findings required by the California Community Redevelopment Law.

 

Section 6. As long as the subject property remains unincorporated territory within the County of Riverside, the County of Riverside shall retain all rights, powers and privileges with respect to land use controls and development review, approvals and authorizations for the subject property.

 

Section 7. Prior to the effective date of this ordinance, the City of Palm Desert, the Palm Desert Redevelopment Agency and the County of Riverside, shall execute an agreement memorializing the requirements and conditions of this ordinance which agreement shall contain provision indemnifying and holding harmless the County, its officer and agents, from any activities undertaken by the City of Palm Desert and the Palm Desert Redevelopment Agency with regard to all redevelopment activities in connection with this proposed redevelopment project.

The boundary of the redevelopment area is illustrated on Exhibit "B" attached hereto. The legal description of the boundary of said area is described as follows:

 

That certain area lying within Sections 1, 2, 10, 11, 12, 13 and 14 of Township 5 South, Range 6 East and also Sections 7 and 8 of Township 5 South, Range 7 East, San Bernardino Base and Meridian, in the City of Palm Desert, County of Riverside, State of California, more particularly described as follows:

 

Beginning at a point on the centerline intersection of Washington Street and Fred Waring Drive (formerly 44th Street), as shown on Tract No. 19748-1, Map Book 142, Pages 49 through 54, Records of said County;

 

Thence South 89 degrees 35' 56" West 0.57 Feet along the centerline of said Fred Waring Drive to the Southeast corner of said Section 13;

 

Thence North 89 degrees 59'57" West 5311.07 feet continuing along said centerline to its intersection with the centerline of Tennessee Avenue as shown on Tract No. 2283, Map Book 42, Pages 82 through 89, Records of said county, said point being the Southwest corner of said Section 13;

Thence Southeasterly along said curve continuing along said centerline through an arc distance of 47.73 feet to its intersection with the centerline of said Fred Waring Drive, as shown on said Tract Map, said point being the point of beginning.
