AN
ORDINANCE OF THE COUNTY OF RIVERSIDE AUTHORIZING AND
APPROVING
THE REDEVELOPMENT OF A PORTION OF THE
UNINCORPORATED
AREA CONTIGUOUS TO THE CITY OF PALM DESERT
BY
THE PALM DESERT REDEVELOPMENT AGENCY PURSUANT TO SECTION
33213
OF THE CALIFORNIA HEALTH AND SAFETY CODE
The Board of Supervisors of
the County of Riverside, State of California, do ordain as follows:
Section 1. Pursuant to California Health and
Safety Code Section 33213, the City of Palm Desert previously requested that
the Board of Supervisors designate and authorize the Palm Desert Redevelopment
Agency to develop a redevelopment plan for that certain real property located
within the territorial limits of the County of Riverside, contiguous to the
City of Palm Desert, more particular shown in Exhibit A, attached hereto.
Section 2. By its Ordinance No. 727, the
Board of Supervisors authorized the City of Palm Desert and the Palm Desert
Redevelopment Agency to develop a redevelopment plan for the property shown in
Exhibit A as if the area were within the City of Palm Desert, except as
provided in Ordinance No. 727.
Section 3. The Palm Desert Redevelopment
Agency has prepared a Redevelopment Plan ,which has been filed with the Clerk
of the Board of Supervisors, (the Redevelopment Plan), for the proposed Project
Area No. 4, which project area contains that certain real property located
within the territorial limits of the County of Riverside, contiguous to the
City of Palm Desert, and has presented such Redevelopment Plan to the Board of
Supervisors.
Section 4. The City of Palm Desert and the Palm
Desert Redevelopment Agency shall have only those rights and privileges with
respect to that certain real property located within the territorial limits of
the County of Riverside, that are necessary for purposes of implementing and
completing the Redevelopment Plan. The County of Riverside shall retain all
rights, powers and privileges with respect to land use controls, development
approvals and all authorizations affecting the unincorporated real property
within the project area as long as said property remains unincorporated
territory within the County of Riverside.
Section 5. Health and Safety Code Section
33213 provides that the Redevelopment Plan must be approved by ordinance of the
Board of Supervisors.
Section 6. Notwithstanding Section 2 of
Ordinance No. 727, the Board hereby finds that the Redevelopment Plan may be
approved by the Board before or after its final adoption by the Palm Desert
Redevelopment Agency.
Section 7. The Board of Supervisors hereby
approves the Redevelopment Plan.
Section 8. Prior to the effective date of this
ordinance, the City of Palm Desert and the Palm Desert Redevelopment Agency
shall execute an agreement with the County of Riverside memorializing the
requirements and conditions of this ordinance which agreement shall contain a
provision providing for a committee composed of City appointees, County
appointees and resident appointees that will make recommendations and approve
all Agency projects and activities funded by tax increment generated from
property located within the unincorporated territory.
