ORDINANCE NO. 766

 

AN ORDINANCE OF THE COUNTY OF RIVERSIDE

REQUIRING CERTAIN PERSONS CONFINED IN

COUNTY CORRECTIONAL FACILITIES TO PERFORM

LABOR PURSUANT TO PENAL CODE SECTION 4017

 

The Board of Supervisors of the County of Riverside, State of California, Ordains as follows:

Section 1.      Purpose and Scope.

The purpose of this Ordinance is to require certain persons confined in County correctional facilities to perform labor pursuant to Penal Code Section 4017.

Section 2.      Definitions.

(a)      Prisoner - For the purposes of this Ordinance, "prisoner" means any person confined in the County Jail, Industrial Farm, Road Camp or similar restrictive County facility under a final judgment of imprisonment rendered in a criminal action or proceeding or as a condition of probation after suspension of imposition of sentence or suspension of execution of a sentence.

(b)      Labor - For the purposes of this Ordinance, "labor" means any physical or mental activity or work directed toward the production of services or goods.

(c)      Public Works or Ways - For the purposes of this Ordinance, "public works or ways" means any project or improvement constructed or maintained by the County of Riverside and districts governed by the Board of Supervisors, including, but not limited to, parks, buildings, paths, roads, streets, highways, public roads and flood control rights-of-way or easements, facilities, reservoirs, channels and sewers.

Section 3.      Prisoners Compelled to Labor.

In accordance with Section 4017 of the Penal Code of the State of California, any and all prisoners as defined herein are required by the County of Riverside to perform labor on the public works or ways.

Section 4.      Direction of Labor.

Work assignments provided for in this section shall be made by the Sheriff and the work shall be performed under the direction of a responsible person designated by the Sheriff, including, but not limited to, work crew supervisors.

Section 5.      Prior Ordinances or Resolutions.

All prior Ordinances or Resolutions of the Board of Supervisors of the County of Riverside inconsistent herewith are rescinded and revoked.

 Section 6.     Effective Date.

This Ordinance shall be effective 30 days following its adoption.
